1. Acceptance

By using Creative Spark ("the Site"), you agree to these Terms of Service. If you do not agree, please do not use the Site.

2. What Creative Spark is

Creative Spark is a free creative prompt generator. Free users are limited to three prompts per calendar day. A paid "Pro" tier is in development.

3. Your use of the Site

You agree that you will not:

• Use the Site for any unlawful purpose.
• Attempt to bypass the daily usage limit through scripting, automation, or multiple accounts.
• Attempt to interfere with or disrupt the Site or its servers.
• Scrape, copy, or redistribute Site content without permission.
• Impersonate another person or entity.

4. Intellectual property

The design, code, and prompt library of Creative Spark are owned by us and are protected by applicable copyright and trademark laws. You are granted a limited, non-exclusive, non-transferable license to use the Site for personal, non-commercial creative inspiration. The output of any prompt (i.e., what you create using a prompt as inspiration) belongs to you.

5. Waitlist and communications

If you sign up for the Pro waitlist, you consent to receive occasional emails from us about Pro availability, features, and launch. You may unsubscribe at any time by replying to any email from us.

6. Third-party services

The Site displays ads through Google AdSense and is hosted on Netlify. We are not responsible for the practices of these third parties. See our Privacy Policy for more detail.

7. Disclaimers

The Site is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or secure. Prompts are for creative inspiration only and should not be relied upon as professional advice.

8. Limitation of liability

To the maximum extent permitted by law, Creative Spark and its operator will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site. Our total liability, if any, is limited to the amount you paid us in the twelve months before the claim arose — which for free users is zero.

9. Changes to the Site or these Terms

We may modify or discontinue the Site at any time, with or without notice. We may also update these Terms from time to time. Continued use of the Site after changes constitutes acceptance of the new Terms.

10. Termination

We may suspend or terminate your access to the Site at any time for any reason, including violation of these Terms.

11. Governing law

These Terms are governed by the laws of the State of Florida and the United States, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Florida.
